What Is the ITR-5 Form?

The ITR-5 form is an income tax return form prescribed by the Income Tax Department of India for entities other than individuals, Hindu Undivided Families, companies, and persons filing ITR-7. It is primarily used by firms, limited liability partnerships (LLPs), associations of persons (AOPs), bodies of individuals (BOIs), and certain other artificial juridical persons. This form allows such entities to report their income, claim deductions, disclose tax liabilities, and provide details of taxes paid during the financial year.

Who Is Required to File ITR-5?

Entities such as partnership firms, LLPs, AOPs, BOIs, and cooperative societies that do not fall under the company or charitable institution category are required to file their income tax returns using ITR-5. It is important to note that individuals and HUFs, as well as companies and entities filing returns under sections 139(4A) to 139(4F), are not eligible to use this form. Filing the correct return form is essential to avoid rejection or delays in processing by the tax department.

ITR-5 Form Filing is designed to capture income from multiple sources, including profits and gains from business or profession, income from house property, capital gains, and income from other sources such as interest or dividends. While filing ITR-5, entities must provide details such as PAN, address, nature of business, and partnership or LLP information. The form also requires financial statements, including balance sheet and profit and loss account details, tax audit information if applicable, and particulars of partners or members along with their profit-sharing ratios. In addition, taxpayers must disclose tax payments made through advance tax, self-assessment tax, and TDS or TCS.

Mode of Filing and Verification

ITR-5 must be filed electronically through the official income tax e-filing portal. After submission, verification of the return is mandatory and can be completed electronically using methods such as Aadhaar OTP, net banking, or digital signature certificate. LLPs and firms subject to audit are generally required to verify their returns using a digital signature.

Due Dates for ITR-5 Filing

The due date for filing ITR-5 depends on whether the entity is required to get its accounts audited. For entities not subject to audit, the return is generally due by 31st July following the end of the financial year. For audit cases, the due date is usually 31st October, subject to extensions announced by the government. Timely filing helps avoid penalties and interest on late payment of taxes.

Failure to file ITR-5 within the prescribed due date may result in late filing fees under section 234F and interest under section 234A. Incorrect or incomplete information can also lead to notices from the Income Tax Department, scrutiny assessments, or penalties.
